Agreement to Terms

By accessing or using CrossCheckCME's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Services Description

CrossCheckCME provides expert medical examination critique services for legal professionals. Our services include analysis of compulsory medical examination (CME) and independent medical examination (IME) reports, preparation of redlined reports, deposition preparation support, and consulting services. All services are provided by qualified medical professionals.

Nature of Relationship

CrossCheckCME is retained solely as a non-testifying Consulting Expert unless otherwise agreed in writing. Our reports, notes, and communications are intended to be attorney work-products, prepared in anticipation of litigation, and generally privileged from discovery to the extent permitted by law.

Our expertise is limited to orthopedic and physical therapy standards. No analysis will be provided regarding psychological or psychiatric issues.

Use of Services

You agree to:

  • Provide accurate and complete information when engaging our services
  • Use our services only for lawful purposes
  • Maintain the confidentiality of any work product we provide
  • Not misrepresent our analyses or opinions

Professional Opinions

Our services provide professional medical opinions and analyses for legal strategy and case preparation purposes only. This service does not constitute the practice of medicine or physical therapy on any individual. These opinions are based on the information provided to us and our professional expertise. The ultimate use of our work product in legal matters is at the discretion and responsibility of the engaging attorney.

Fees and Payment

Payment is due in full upon receipt of the invoice. Payment is expected before services are rendered. Due to the time-sensitive nature of the analysis, fees are non-refundable once the review process has commenced. We reserve the right to suspend services for overdue accounts.

Confidentiality

We treat all case materials, documents, medical records, videos, and client information as strictly confidential. We will not disclose case-related information to third parties without express written consent, except as required by law.

Intellectual Property

All work product created by CrossCheckCME remains our intellectual property until payment is received in full. Upon full payment, you receive a license to use the work product for the purposes of the specific legal matter for which it was commissioned.

Limitation of Liability

CrossCheckCME makes no guarantees regarding the outcome of the legal matter or the admissibility of any critique in court. To the maximum extent permitted by law, CrossCheckCME shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the fees paid for the specific engagement giving rise to the claim.

Modifications

We reserve the right to modify these Terms of Service at any time. Changes will be effective upon posting to this page. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
