Physical examination reveals full range of motion1 with no neurological deficits.
Ongoing symptoms attributable to pre-existing degenerative changes2 unrelated to the incident.
"Standard soft tissue injuries resolve within 90 days..."3
Testing Omission
ROM claimed as "full" but lumbar side bending and rotation were not performed. L5 myotome testing and Straight Leg Raise test were omitted.
Pre-existing Defense Flaw
Using the Eggshell plaintiff rule: pre-existing degenerative changes found on MRI were asymptomatic but rendered symptomatic by trauma of the accident.
Unsupported Timeline
The oversimplified "90-day healing" claim contradicts peer-reviewed literature on complex injuries suffered in motor vehicle accidents.

What Attorneys Are Saying
Paul Rouleau provides litigation consulting services in connection with the review of Compulsory Medical Examination (CME) reports, examination videos, and related deposition transcripts. His work includes preparing written analyses comparing CME reports to examination video recordings and identifying factual discrepancies, omissions, or areas requiring clarification. Mr. Rouleau serves solely as a non-testifying litigation consultant. He is not an attorney, does not provide legal advice, and is not retained as an expert witness.

Before You Engage
The questions trial attorneys ask most—answered straight.
01 Is Paul's involvement discoverable?
Paul works strictly behind the scenes as a non-testifying consultant. He never appears on a witness list and never takes the stand—his analysis is built to sharpen your own preparation and cross-examination. How consulting work is treated is governed by your jurisdiction's rules; many attorneys engage him for exactly that reason. We're glad to talk it through on a call.
02 How does this compare to retaining an expert witness?
It's a fraction of the cost. Because Paul consults behind the scenes and never has to testify, you get clinical firepower—skipped tests, unsupported healing timelines, pre-existing-condition arguments—without paying a testifying expert's retainer.
03 What do I need to send?
The defense CME/IME report at minimum. When available, the exam video or recording, the transcript, and relevant medical records make the analysis far deeper—omissions are often clearest on the exam footage itself.
04 What do I get back?
An annotated, redlined breakdown of what the defense expert missed or got wrong, a set of targeted deposition questions you can use directly, and supporting clinical citations. Turnaround tiers are shown when you start a review.
05 Is my client's information secure?
Yes. Your files live in a private, encrypted workspace reached through a unique secure link sent to your email—no account required, and nothing is shared outside the engagement.
06 Who is actually doing the analysis?
R. Paul Rouleau, PT, OCS, COMT, FAAOMPT—a board-certified orthopedic physical therapist with 30+ years of clinical experience and 10+ years analyzing CME/IMEs for trial attorneys. He is a consultant, not an attorney, and does not provide legal advice.
